What is a wrongful death?

The death of a loved one is always a difficult event for their surviving relatives. When old age claims a beloved leader in a family, their descendants may mourn them but remember the full life they lived. When a young person passes away from an illness, their loved ones may struggle to understand why their life was cut so short.

Perhaps, however, the most difficult type of death for a family to understand is a death caused by an accident. Every year too many New Jersey residents are killed in motor vehicle accidents, property incidents, and other negligence-based events. These deaths are tragic because they are often preventable, and the consequences of some individuals' reckless actions lead to the losses of life of innocent parties.

When a death is caused by negligence or recklessness, it may be considered wrongful. When a death is caused by the actions of another person and there is no justification for those actions, there can be no justification for the loss of life. When a wrongful death happens, the surviving relatives of the deceased party may be able to seek damages through personal injury litigation.

Readers of this post are reminded to always seek their own legal advice before they engage in litigation. There are civil procedures in place that govern how pleadings must be drafted, who may bring them, and when such claims may be made. The support of a personal injury attorney may save a grieving family from making costly mistakes when pursuing their losses in a wrongful death claim.
