Respecting and carrying out a client’s wishes

In our previous post, we wrote about one of the most celebrated actors of our time: Philip Seymour Hoffman, who died at age 46. As you might recall, the Oscar-winning actor was adamant that his three young children, ages 5, 7 and 10, not be “trust fund kids.”

Our point in the post was not to pass judgment on the actor’s wishes, but to note that a trusted estate planning attorney helps a client understand the consequences of their goals, and then helps them utilize the best available legal tools to realize their well-considered objectives. 

After all, the estate plans our Flemington law firm helps clients create are as unique as the clients themselves. Some clients have significant assets that they want to pass on to a spouse, children and good causes and therefore want to minimize any impact inheritance taxes might have on beneficiaries. Other clients have more modest assets that are no less important to them; assets they want transferred just as thoughtfully and carefully to those they care about most.

The process of planning and carrying out a client’s wishes begins with understanding those wishes. That means sitting down with a client, listening carefully and then explaining in detail how certain legal tools – including wills, trusts, living wills, guardianships and others – can be used to make sure their estate plans are carried out exactly as planned when the time arrives.
